Major Win Alert: Jones Jones LLC Partner Tackles Fraud Case

Congratulations to Jones Jones LLC Partner Katherine Caracappa and her all-female construction defense team for securing a disallowance on a recent fraud case before the New York State Workers’ Compensation Board. Fraud and construction are being scrutinized by both the Board, as well as other state and federal entities due to the recent Racketeer Influenced and Corrupt Organizations Act (RICO) cases making headlines throughout New York.

 

In the case at hand, the plaintiff originally reported slipping on debris causing injury while working at a construction site. A similar case was also filed by another plaintiff with very similar fact patterns and medical details.   Both plaintiffs claimed to be injured on the same day, at the same jobsite and appeared to be injured in the same manner. The two individuals initially went to the same hospital, were treated by the same physicians, were represented by the same law firm and switched to another law firm together. In addition to the questionable coincidences, the original claimant reported contradictory medical histories regarding the nature of their injuries and failed to mention the supposed witness (the other plaintiff) on his employee claim (C-3) form.

 

During cross-examination, Caracappa and her team pushed the claimant on conflicting testimonies including differing mechanisms of injuries that was recounted in a variety of documents- both legal in nature and medical.  Additionally, Caracappa was able to bring to the Law Judge’s attention the plaintiff’s failure to mention any witnesses -including the other alleged plaintiff- and the interesting question as to how both plaintiffs come to have the same legal representation.

 

The undertones of the recent RICO cases impacting the New York construction industry prompted the law judge’s decision to find fraud on this case. The law judge noted similar fact patterns in both cases, with neither acknowledging each other in their own cases. Based on the RICO concerns throughout the case, the law judge also noted it would be referred for criminal prosecution.

Major Win Alert: Jones Jones LLC Partner Saves Client Nearly $10 Million in Permanent Total Disability Case

Jones Jones LLC congratulates Partner Dana Sabghir and her team on negotiating a $15 million claim down to an approximately $5 million settlement at mediation in a permanent total disability workers’ compensation case, saving the client nearly $10 million.

 

The client, a public benefit corporation involved with the construction of public buildings throughout New York City, had concerns regarding the settlement and its potential financial implications due to an independent medical examiner determining permanent total disability. Sabghir and the Jones Jones LLC Construction team requested a cross-examination of the claimant’s personal, non-workers’ compensation neurologist. The neurologist’s testimony acknowledged numerous incidents leading up to the claim that brought fraud into question based on the extent of his neurological claim, seizures, subsequent hospitalization and cervical spine surgery, in-patient rehabilitation and more.

 

Through a successful cross-examination, Sabghir was able to raise fraud as a concern resulting in a strong basis for negotiation. The client ultimately settled for nearly $10 million less than anticipated, and the claimant agreed to pay all outstanding Notices of Objection to a Payment of a Bill for Treatment Provided (C8.1Bs).

Major Win Alert: Jones Jones LLC Permanently Closes 14 Cases with Settlement Day-over $100K Saved

Jones Jones LLC is pleased to share Partner Yvie Cherenfant recently hosted a successful settlement conference on behalf of a client that is in the entertainment space. With the Jones Jones’ “always be closing,” mentality top of mind, Yvie and her team coordinated with the injured workers’ firms and the carrier to set up the successful settlement conference. Together, the groups obtained authority on all cases involved and to date, Yvie and her team have settled 14 cases, saving Jones Jones’ client approximately $100,000.
