Jones Jones Secures Nearly $50,000 in Client Savings Through Successful Schedule Loss of Use Reduction

Congratulations to Jones Jones Associate Samantha Sokoloff for securing a significant victory that reduced a claimant’s schedule loss of use (SLU) award and saved the client nearly $50,000.

In this case, the claimant’s medical exam showed a 50% SLU to the right shoulder, which was approved by the Workers’ Compensation Board in September of 2025. After reviewing the case, the Jones Jones team found the claimant had undergone a reverse prosthetic total arthroplasty, a type of shoulder joint replacement, to the right shoulder which would entitle the claimant to no more than a 35% SLU.

Samantha and her team challenged the Board’s decision, highlighting the deficiencies in the claimant’s medical record. After appealing the Board’s decision, a hearing was held. At the hearing, Jones Jones cross-examined the opposing doctor’s SLU findings and argued for a 35% SLU. The judge issued a reversed decision in support of Jones Jones’ argument.

Through a careful examination of the provided medical evidence and thorough knowledge of New York SLU guidelines, Samantha and the Jones Jones team were able to reduce the claimant’s SLU by 15% and save the client nearly $50,000.
